Judge Nap: Trump's Comments on Due Process Represent What Gun Owners and the NRA Fear Most :: 03/01/2018
President Donald Trump on Wednesday shocked some Republicans and guns rights advocates by voicing support for confiscating guns from certain individuals deemed to be dangerous, even if it violates due their process rights.
“I like taking the guns early, like in this crazy man’s case that just took place in Florida ... to go to court would have taken a long time,” Trump said during a meeting with lawmakers on gun violence. “Take the guns first, go through due process second.”
On "Outnumbered" on Thursday, Judge Andrew Napolitano speculated that Trump was either thinking out loud, taking an extreme position for the purposes of negotiations or forgetting that he took an oath to protect and defend the Constitution, which includes the Second and Fifth Amendments.
"That statement will really animate the gun owners of the country and the NRA against him, because this is exactly what they fear most: confiscation first, trial later," Napolitano said.
Marie Harf noted that taking guns before due process is much more extreme than anything Democrats are calling for.
"If Barack Obama or Hillary Clinton had said, 'We're gonna take your guns and then go through due process' ... it's hard to fathom the amount of outrage that would be there," Harf said.
